REQUEST FOR INTEREST FOR CONTRACTED HEARING OFFICERS

IDAHO STATE DEPARTMENT OF EDUCATION OFFICE OF DISPUTE RESOLUTION FOR SPECIAL EDUCATION
The Idaho State Department of Education (SDE), Division of Student Achievement and School Improvement, is seeking up to four interested parties to contract as hearing officers to conduct administrative due process hearings regarding special education disputes under Part B of the Individuals with Disabilities Act (IDEA) and Idaho law. In accordance with the IDEA, a parent, guardian, or the responsible education agency may request a due process hearing by the state board of education with respect to any matter relating to identification, evaluation, educational placement, or the provision of a free appropriate public education of the child.

Hearing officers may hear a case and render a decision or may dismiss a case prior to the hearing due to lack of merit. Settlement is sometimes reached by the parties and is identified as a hearing decision. Stringent deadlines, record keeping, and procedures are mandated by federal regulations. The minimum qualifications require contractors to:
Be licensed to practice law in the State of Idaho and be in good standing with the Idaho Bar for the duration of the contract;
Possess the knowledge and ability to conduct hearings in accordance with appropriate standard legal practice;
Possess the knowledge and ability to render and write decisions in accordance with appropriate standard legal practice;
Be available and participate in hearing officer training sessions as required and provided by the state agency;
Ability to travel throughout the state of Idaho;
Be impartial and free of any conflicts of interest. Applicants should not have actively represented schools or families in due process hearings within the last year.

Superior candidates will have the following qualifications:
5+ years of experience as an attorney, with experience in conducting due process hearings;
3-5 years of experience working with legal issues specific to education and special populations;
Be familiar with the provisions of Part-B of the IDEA. The contractor shall also have knowledge of and the ability to understand the provisions of state and federal law and regulations implementing IDEA as well as court interpretation of IDEA. The knowledge can be via personal experience, self-study, workshop/conference attendance and/or attendance at state agency in-services.

The SDE will conduct mandatory training for up to four new hearing officers on June 6, 7 and 8, 2011 in Boise, ID. Interested parties should mail, fax or email a resume and cover letter explaining how the applicant meets the minimum qualifications above to:

U.S. Attorney’s Office seeks a Special Assistant U.S. Attorney

The United States Attorney’s Office for the District of Idaho and Canyon County Prosecutor’s Office, in collaboration with Treasure Valley Partners, are seeking a Special Assistant U.S. Attorney to handle a heavy criminal caseload involving a wide variety of criminal prosecutions, including violent crime, firearms and drug offenses related to gang activity. This position will be for a term of three years but may extend beyond that, at the discretion of the U.S. Attorney’s Office, the Treasure Valley Partners and the Canyon County Prosecutor’s Office.

Lawyer Representative to Ninth Circuit

All: 

For the past few years, I’ve been involved in representing the U.S. District Courts for the District of Idaho in the Ninth Circuit, first as a Lawyer Representative (3 year term) and more recently being elected to serve as an officer of the group that oversees all 170+ lawyer representatives in the Ninth Circuit.  It has been an amazing opportunity that has allowed me great access to our federal bench in Idaho and throughout the Circuit.  Our court is currently soliciting applications from the 4th District for a lawyer representative — this person will take over for out-going lawyer rep Steve Anderson.  A lawyer rep serves for 3 years and is expected to: (1) attend quarterly meetings with the Board of Judges of the federal court; (2) help plan and execute the annual federal court road show; and (3) attend the Ninth Circuit’s annual judicial conference (and, as a senior lawyer rep, help plan some of the programs).  All of your expenses are reimbursed by the court.  This year the Ninth Circuit’s conference is in Maui and next year its in San Diego — it’s a good gig!
